Justice Yasin Nyanzi signed the orders on Tuesday following an agreement between NEMA's lawyers Sarah Naigaga and Stella Muheki and the applicant’s lawyers, Achilles Lubega, Isa Kavuma and Adam Kirumira. In their consent agreement, the parties agreed that both residents and NEMA provide proof ownership of the suit land before they return to court on August 18, 2020.
A source at Arua Chief Magistrate’s court told URN that the suspects used a master key to open the gate to the cells around 11:00am and escaped. Three other suspects remained in the cells yelling, which attracted the attention of court officials.
The panel of three Judges of the East African Court of Justice led by the Principal Judge Monica Mugenyi dismissed the matter on Tuesday after two lawyers Nelson Ndeki and Don Deya representing the politicians told the court that they were not willing to proceed with the case. Other Judges on the panel are; Justice Dr Peter Nyawello and Charles Nyachae.
