In their defense both Nadiope and the Attorney General opposed the petition, saying it does not raise any issue for constitutional interpretation. The Attorney General argued that the acts complained of and attributed to Kadaga and others did not violate the constitution.
The application is seeking review of November 26th, 2020 ruling where Justice Masalu reverted Aloet and Opiyai wards to Soroti City West Division. The wards, that were initially in Soroti City West during creation of Soroti City were moved to Soroti City East Division. The application is also seeking to nullify elections of Soroti City.
Through his lawyers; Wameli and Company Advocates, Kyagulanyi says that he has been targeted since his participation in politics especially after the recently concluded presidential elections. He says that his properties, including vehicles, have been unlawfully impounded or retained by the government.
This development has come at the time when the Supreme Court has fixed March 4 2021 to hear an application in which Kyagulanyi wants to withdraw his petition as a whole.
Judiciary Spokesperson Solomon Muyita says the process doesn’t end when the notice for withdrawal has been put in the gazette, but that the court has to reconvene and the hearing of the application has been fixed for March 4th 2021.
