Balikuddembe, a candidate of the National Unity Platform-NUP had sought leave of the court to submit additional evidence to support his petition to the effect that Kitatta, the National Resistance Movement-candidate connived with the Electoral Commission to rig elections in Lwengo.
Bagala won the January 14 polls with a margin of 16,000 votes to defeat Nabakooba. But in March, Nabakooba filed a petition to challenge the outcome of the polls, alleging that Bagala was not validly elected to represent Mityana District in Parliament, on grounds that the Electoral Commission failed to secure conditions necessary for the conduct of the election.
“…the Batwa have been left disadvantaged, owing to their eviction from the said land, and also due to the nonpayment to them of adequate compensation which would have facilitated in their relocation to similar lands. This had rendered them landless and has severely affected not only their livelihoods but has destroyed their identity, dignity and self-worth as a people and as equal citizens with other Ugandans,” Justice Musoke ruled in a lead judgment.
The summons was issued on Friday by the Grade One Magistrate Marion Mangeni following a request of State Attorney Ivan Kyazze. Kyazze told the court that Ssegirinya was supposed to appear today but neither he nor his lawyers showed up for further hearing of his case.
During the hearing at Kabale High Court Mutabazi’s lawyer, Akram Matovu asked the court to summon top officials from the Ministry of Education and Sports, National Council for Higher Education to appear before the court to defend the legitimacy of Bizimana’s academic credentials.
The petition was filed by Jeremiah Kamurari, a challenger for the same seat in the just concluded elections challenging Nathan Byanyima’s academic qualifications. Kamurari had argued that Byanyima did not have the requisite qualifications to contest for a parliamentary seat.
Turyamuhweza petitioned the court saying that there was voter bribery and ballot stuffing. He also accused Muhwezi of conniving with security officials in the district to intimidate and chase away his agents and supporters from polling stations on polling day.
Guwatudde was arrested by the State House Anti-Corruption Unit in April last year and charged jointly with the Head of the Procurement Unit Fred Lutimba Kyeyune, Under Secretary Joel Wanjala and Martin Owor, the Commissioner in charge of Relief and Disaster Preparedness and Head of the COVID-19 Relief Management.
Retired Justice of the Supreme Court Eldad Mwangusya said when you read a number of cases that courts determined, there is no consistency in decisions even on matters that are of a similar nature.
