While delivering his judgement, Justice Wangututsi rejected Mpagi’s defense, saying it was full of blatant lies because the evidence tendered in court showed that upon his arrest, he led police to the dormitory where he would abuse the boys from.
This morning, Justice Anthony Oyuk Ojok dismissed Namasa’s petition with costs, saying that he did not find substantive evidence to nullify Mafabi’s victory. He said the petitioner failed to prove to court about the said irregularities and how they affected the outcomes of the polls.
In her judgement, Justice Tibulya noted that the prosecution was able to prove its case beyond a reasonable doubt. Earlier on, the prosecution told the court that on April 6th and 8th 2017, Kabafunzaki directly solicited and accepted a bribe of Shillings 5million from Hamid Muhammed, the Chairperson of Aya Group of Companies as an inducement to clear him of sexual abuse allegations by his former employee, Jamila Opondo.
