The order given on Friday night by the Civil Division Judge Musa Ssekaana arises from an application filed by one of the aggrieved members of the Uganda Law Society-ULS, Hashim Mugisha Mugisha challenging the legality of the meeting and manner in which the posts that were to be filled fell vacant.
The law firm, led by lawyers Alex Candia and Oundo David Wandera, sought to tax an advocate-client bill of costs for their services in Civil Suit Number 261 of 2010, where Kemigisa sought to recover 3.831 billion shillings from the late lawyer Bob Kasango, and Criminal Case No. 726 of 2010, where Kasango was convicted and sentenced.
In his decision, Ssekaana has explained that the actions of Atabua did not only constitute a breach of university rules and regulations but it is also a criminal offence under the Computer Misuse Act.
Justice Ssekana said that misuse or abuse of power should never be a ground to deem an action overtaken by events otherwise illegalities would be perpetuated by ensuring that the status quo is changed hurriedly without any justification or basis.

Mabirizi ran to the appellant court when Justice Ssekaana found him guilty of contempt of court on February 15th, 2022 and sentenced him to 18 months in civil prison. The same had earlier on January 27th, 2022 issued orders stopping Mabirizi from using his social pages to attack judicial officers.
A section of lawyers interviewed by URN on Mabirizi's conviction have expressed mixed feelings. Some of the lawyers described the sentence as harsh and advised him to appeal and the sentence.
Chapter Four Uganda’s Nicholas Opiyo says that by Mabirizi’s behavior alone, he is narrowing the court's tolerance of public interest litigation and hopes that courts can move beyond the single litigant irritation to uphold the expansive realm of public interest suits in the constitution in matters of human rights enforcement.
In his decision delivered to parties via email on Friday, Justice Musa Ssekaana the head of Civil Division of High Court dismissed the petition filed by Water and Environment Media Network Uganda Limited, National Association of Professional Environmentalists -NAPE and Africa Institute for Energy Governance.
According to the statement from the Judiciary, Ssekaana, who has been the deputy head of the court, replaces Justice Michael Elubu who has been transferred to the Criminal Division.
Justice Ssekaana will be charged with the responsibility of allocating the suits filed in the court to appropriate judges for adjudication. The Judiciary Spokesperson, Solomon Muyita told URN this morning that Ssekaana's appointment is in recognition of his hard work in the division.
In his judgment, Justice Musa Ssekaana noted that he had looked at the Police report and found that indeed the said parking yard belonged to Ntulume. He also noted that it is really surprising that a person who doesn’t own a commercial parking yard executed agreements to repair vehicles he claims were not his responsibility.
