In the application filed on Wednesday, Byanyima is seeking a writ of habeas corpus, requiring the Attorney General and the Commissioner of Prisons—the only listed respondents—to produce Besigye and Lutaale before the court.
As a result, Uganda Prisons Service Spokesperson Frank Baine stated that they are waiting for instructions from the Attorney General, who was the appellant in the case. "You know what happened on Friday. The Supreme Court ruled, and now we are waiting for instructions to make the next move," Baine said.
The order was issued on Thursday by Senior Principal Grade One Magistrate Winnie Nankya Jatiko when the matter, in which Besigye is jointly charged with fellow opposition politician Samuel Lubega Mukaaku, came up for further hearing.

In the contested report, the Scene of Crime Officer Oryema stated that June 14th 2022 at about 1300c ,information was received from the oyc operation CPS Kampala ASP David Nahamya that there was alleged case of incitement of violence at Namirembe Road by Dr. Besigye and Lubega who were in the motor vehicle registration number UAK 773F Prado TX white in colour.
The order arises from an application filed by Besigye in the criminal proceedings instituted against him and activist Samuel Walter Lubega Mukaaku following their arrest on June 14, 2022, on charges of inciting violence. The two were arrested for leading protests against skyrocketing commodities prices at Kikuubo Shauriyako Parish in Kampala Central Division.
Lukwago said that the bail amount is outrageous since his client has been under preventive arrest at his home for almost two weeks and he has not been working.
According to Lukwago, Besigye has instructed them to appeal against the decision and has chosen to be remanded.
Equally, a day later Dr Kiiza Besigye who crowned himself as the People’s President after losing 2016 elections hosted People’s parliament’ at his home delivering to them what he called the state of the nation address.
Dr Besigye was the chief guest during thanksgiving prayers organised by Denis Onekalit Amere, the Kitgum Municipality Member of Parliament-elect over the weekend. Amere defeated State Minister for Environment Beatrice Atim Anywar in the January 14, parliamentary polls.
However, speaking to URN today at the Constitutional Court on Thursday, Besigye said that to date, he still wonders how the Constitutional Court Justices came to sit and dismiss his petition in the presence of Attorney General’s representatives on a day that was never communicated to him and his lawyers.
In 2019, when Besigye was seeking the scrapping of the offence of unlawful Assembly, Constitutional Court Justice, Kenneth Kakuru declined to grant his petition and advised him to seek remedies in his own courts, or the Judge who swore him in as President.
However, Judiciary Public Relations Officer Jameson Karemani has clarified that Besigye can have the case reinstated if he or his lawyers are willing to show up for the hearing.
