"The Appellant has decided to withdraw the above Election Petition having lost interest to prosecute the same for a number of reasons but most of all the continued incarceration of the 1st Respondent has portrayed the Appellant as if he is on the side of the tormentors," reads the letter.
Nayiga told the Court that the Managing Director of UBC Radio tasked her to translate and transcribe videos of Ssegirinya inciting violence delivered by the Criminal Investigations Directorate of the Uganda Police Force.
The State Attorney, Peter Mugisha strongly objected to the bail application, arguing that although Ssegirinya has not yet been convicted, the charges against him show that he is not a responsible member of society.
Ssegirinya is currently admitted at Mulago National Referral Hospital where he was taken after his health condition deteriorated. He had been detained at Kigo Prison and later transferred to the Murchison Bay Hospital, in Luzira; the national referral hospital for prisoners.
Francis Mwijukye, the Buhweju County MP, says that even with the pain the MPs are in, Kigo Prison has only a health centre III yet the MPs want specialised treatment, which they can’t access at the facility. He says Ssegirinyas condition is particularly alarming.
Ssekikubo says that Government cannot sit and debate among themselves, saying the opposition exists as by the laws that govern Parliament and multiparty democracy. He says Parliament should not go on like everything is normal and debate with a one sided house.
Kidandala had also alleged that Ssegirinya’s nomination was not accompanied by the names and signatures of a minimum of ten persons who are registered voters in the Kawempe North constituency, as required by the law.
The former Kampala Deputy Lord Mayor ran to court seeking to overturn Ssegirinya’s victory in the January 2021 parliamentary elections on grounds that he lacks the minimum advanced level academic qualifications for election as members of Parliament.
The summons was issued on Friday by the Grade One Magistrate Marion Mangeni following a request of State Attorney Ivan Kyazze. Kyazze told the court that Ssegirinya was supposed to appear today but neither he nor his lawyers showed up for further hearing of his case.
Kidandala’s legal team comprising Caleb Alaka, Kenneth Paul Kakande and Fred Kato has been struggling to serve Ssegirinya who is on remand in Kitalya prisons where he was remanded for inciting violence.
