The three applications arise from an appeal in which Wakayima's rival Hamis Musoke Walusimbi is challenging the September 22 2021 High Court decision by Lady Justice Henrietta Wolayo that upheld his victory and ruled that he has the prerequisite academic documents to be in Parliament.
Wakayima through his lawyers of Lex Uganda Advocates and Solicitors wants the appeal in which his rival Musoke Hamisi Walusimbi wants him thrown out of Parliament over name discrepancies dismissed for having been filed out of the stipulated time of 14 days.
Through his lawyers of Kabega, Bogezi and Bukenya and Co Advocates, Walusimbi says Justice Wolayo erred in fact and law when she ruled that Wakayima possessed the minimum academic qualification for election as Member of Parliament whereas not.
The Judge ruled that Wakayima's Uganda Certificate of Education, Uganda Advanced Certificate of Education and Diploma in Secondary Education from ITEK were duly verified by the issuing authorities and therefore valid.
The victory of Wakayima Musoke Hannington Nsereko is being challenged by his rival Hamis Musoke Walusimbi who accused him of lack of academic qualifications to be in Parliament due to discrepancies in his names.
According to the report which was released on February 25th 2020, but its findings made public in court on Tuesday for the first time, the investigations led police to UNEB where the academic transcripts in question were verified by the national examination body and were found to be genuine.
