Mabirizi wants the pretrial hearing halted until the determination of his constitutional petition challenging the legality of the charges against the legislators and five others.
Justice Muwata then proposed that Mabirizi returns to the court for a ruling on June 7th, 2022. In his response, Mabirizi said that he might not be available because he is in negotiations with the Uganda Prisons Services to transport him either by bus or any other means to argue his case in Arusha.
While delivering his decision, Justice Wamala agreed with the Attorney General's representative Ebila that the application had since been overtaken by events and that the issues Mabirizi was raising were already taken to the Court of Appeal.
