The pistol, black in color, was on Monday presented by Derrick Nasawali, a Firearms Examiner and head of Ballistics and Toolmarks at the Uganda Police Force's Forensic Department.
Detective Inspector of Police Enock Kanene, who retrieved and analyzed the footage as part of the police investigation, played the videos on a large screen before Lady Justice Rosette Kania Comfort on Wednesday.
The three assessors in this case are Simon Atongo, Sharp Mutonyi, and Consolate Tabu, who were appointed by the first trial judge, Isaac Muwata, to attend the daily hearings and advise the court on whether to convict Molly Katanga and four other accused individuals on charges related to the death of businessman Henry Katanga.
The judge explained that the said items would be marked and identified until the witnesses who recovered them came forward to testify and tender them as exhibits. "It, therefore, follows that a chain or evidence has to be followed before the exhibits are admitted right from the time of recovery to the tendering," said Muwata.
According to the testimony of Dr Ambayo,the bullet had entered Katanga's head seven centimeters below the vertex and exited through the ear, causing commuted fractures and injuring his brain.
The prosecution secured permission to amend the charge sheet to charge Patrica Kakwanzi and Martha Nkwanzi as accessories after the commission of murder. They denied the charge.
The lawyers of the accused want one of the lead prosecutors off the case.
The Court has heard that on November 2, 2023, at Mbuya, Chwa II, in Nakawa Division, with malice aforethought, Molly Katanga killed her husband, Henry Katanga.
“In the new application, it could be concluded that the applicant has failed to prove her condition couldn’t be managed by prison authorities. There is no new ground of ailment raised in the application but rather a mere mention of it. This matter was considered in the previous application,” said Justice Muwata.
According to Molly, before being committed to the High Court and later remanded to Luzira Women’s Prison, she had spent over two months at C-Care IHK Hospital where she received specialized treatment and underwent five major surgeries to her scalp and hands. She added that the injuries require a lot of specialized post-operative care for her recovery, which is not available in prison.
The trial date was determined after a planning meeting between the judge, Katanga's legal representatives, and the Office of the Director of Public Prosecutions (ODPP).
She lists a Minister, a Uganda People's Defence Forces General and One of the men who married President Yoweri Kaguta Museveni's daughter (Museveni's son in law) as her proposed sureties to Court.
According to the Prosecution, the applicants did not raise any valid exceptional circumstances, and those that resemble the circumstances do not fit within the meaning of the law. The Prosecution pointed out that the medical reports attached by the first and second applicants regarding their health conditions do not qualify as grave illness as required by Section 15 of the Trial Indictments Act.
The Prosecution argued that Molly's alleged sickness couldn't be substantiated in court, and they sought the warrant based on completed investigations and urged the court to commit the case to the High Court for trial.
To support their arguments , the lawyers have then presented a letter and still pictures explaining that Molly Katanga was operated upon for those injuries and she is therefore not yet stable to attend court .
Patricia Kakwanza, a shamba boy at the late Henry Katanga's home, and Charles Otai a Nursing Officer were arraigned before the Chief Magistrate, Erias Kakooza on Tuesday.
