Earlier in the day, a representative of the Directorate of Public Prosecutions Isaiah Wanamama told court that the constitution does not allow the DPP to proceed in matters before the General Court Martial.
The ruling was made this morning in response to an appeal in which Kabaziguruka and others were challenging their trial at the court saying that it is unlawful to have face trial before the army court because they never committed service offence as stipulated in the UPDF Act.
