According to the Judge, due process here means that if Kyagulanyi had any offense that he had committed, he should have been arrested, taken to police and produced to any Magistrates Court to be charged which has not been the case here.
According to Bukenya, his arrest, detention and prosecution, dented his reputation and credibility leading to loss of employment. He therefore wants court to declare his arrest and detention illegal and compel government to compensate him.
The suspects are accused of illegally detaining Consolata Kyomukama and Merab Tukamuhabwa all residents of Bubare Sub County in Rubanda district. The two had reportedly failed to honor their loan obligations.
