Anthony Wameli Lists Two Grounds of Appeal Against Court Ruling

Wameli wants the Appellant Court to allow his appeal, set aside the decision of the High Court and declare him as the duly elected MP for Namisindwa County.

The loser of the Namisindwa County MP seat Anthony Wameli has listed two grounds in his appeal against the High Court ruling.

The Electoral Commission declared and Apollo Masika a candidate of the National Resistance Movement-NRM party winner with 10, 230 votes after trouncing six other male rivals. 

Wameli who contested on the National Unity Platform-NUP Party ticket emerged second with 4,047 votes. But Wameli challenged his rival’s victory at the Mbale High Court circuit seeking to nullify Masika’s victory on grounds that he lacks the required minimum academic qualifications to be elected as a Member of Parliament. Masika was also accused of voter bribery.

According to Wameli, Masika donated 100,000 shillings to Bumumali Church of Uganda building Committee and Solar power parcels to Bumumali Primary School during the campaigns in Namisindwa County, Namisindwa District.

On October 13, Lady Justice Joyce Kavuma dismissed Wameli’s petition with costs after finding that Masika possessed the requisite academic documents to be elected as a Member of Parliament.

She also noted that Wameli failed to bring sufficient evidence to prove the allegations of bribery against his opponent. 

Wameli has appealed to the Court of Appeal raising two grounds saying that the trial judge erred in fact and law when she found that Masika at the time of nomination and the subsequent election was qualified for election as a Member of Parliament.

He further states that the trial judge erred in law and fact when she ruled that he (Wameli) failed to satisfy Court that his opponent Masika committed the illegal practices.

Wameli wants the Appellant Court to allow his appeal, set aside the decision of the High Court and declare him as the duly elected MP for Namisindwa County.

Wameli is also seeking the election of Masika to be set aside, his seat declared vacant and court orders for a fresh election. 

Through his lawyers of Wameli and Company of Advocates, Wameli also wants Court to order Masika to pay him the costs of the suit.

The appeal is yet to be fixed for hearing before a panel of three Justices of the Court of Appeal.
