Arua Treason Investigations Incomplete, Case Pushed to March

The mention of a case in which Kyaddondo East MP Robert Kyagulanyi and 33 others are charged with treason, has been adjourned to March 2019. The prosecution says investigations into the matter are still incomplete.

The case stems from the arrest of supporters of people power, a pressure group led by Kyagulanyi following the chaos that dominated the last day of campaigns ahead of the Arua Municipality by-election in August 2018.

It is alleged that Kyagulanyi and his contemporaries commanded a team of youths that obstructed the president's motorcade and pelted stones that smashed the windscreen of one of the vehicles in the convoy. In the aftermath, four legislators and several other politicians were arrested and charged with treason before the magistrate's court in Gulu.

The others on trial include Jinja Municipality MP Paul Mwiru, Ntungamo Municipality MP Gerald Karuhanga, Arua Municipality MP Kassiano Wadri and former Makindye East MP Michael Mabikke, among others.

Today, they appeared before the court presided over Grade one Magistrate Isaac Kintu Nimran for mention of the case. But State Attorney Julius Ocen told the court that the Police was yet to complete investigations into the matter. He, however, did not divulge details on the progress of the investigations.

Tony Kitara, a lawyer representing the suspects said the delays in completing the investigations are turning the matter into persecution of the suspects as opposed to prosecution. He said that the state should be put on notice that the suspects have commenced plans to apply for dismissal of the case.

The same position was reiterated by MP Ntungamo Municipality Member of Parliament Gerald Karuhanga, one of those facing trial.

The Magistrate adjourned the case to March 14. He also summoned the officers in- charge of Criminal Investigations and Intelligence Department in Gulu and Arua to appear in court and explain the status of exhibits in the matter.
