Court Asked to Dismiss Petition Against Kashongi County MP

Tayebwa through his lawyer Geoffrey Kandeebe, on Monday, told the court presided over by Justice Moses Kazibwe Kawumi that Tumuramye was illegally nominated by the Electoral Commission. According to Kandeebe, the document he attached on the petition as the nomination paper had only signatures from nine registered voters instead of ten.

Lawyers representing the Kashongi County Member of Parliament Herbert Tayebwa Musasizi have asked the court to dismiss an election petition against the MP. 

Musasizi’s victory was challenged by his rival Genesio Tumuramye. Tumuramye, who contested as an independent candidate lost the race with 7,500 votes, while Musasizi, a candidate for the ruling National Resistance Movement-NRM party polled 7,790 votes.

But Tumuramye accuses his opponent of engaging in voter bribery, intimidation, ballot stuffing. He adds that many of his agents were dismissed from polling stations to facilitate rigging, on polling day.

According to Kandeebe, the nomination paper that Tumuramye attached on the petition had only signatures from nine registered voters instead of ten.   

Kandebe told the court that the law requires among others for a person to be nominated is that they should have signatures of 10 registered voters in the constituency.

However, Tumuramye’s lawyer Jadson Agaba objected to the documents noting that the Electoral Commission was satisfied with the number of signatures presented and thus nominated him. 

Last week, Justice Kawumi directed the Criminal Investigations Department to provide certified statements of the witnesses to be cross-examined in court during the hearing of the petition. 

The statements were recorded from the witnesses by the police when Tumuramye opened a case of intimidation at Kiruhura police station against Tayebwa and his agents.
