Justice Henry Kaweesa Isabirye has issued an arrest warrant for Matthew Kirabo, who accused of murdering Desire Mirembe, who was a Makerere University medical student.
This comes after the State Attorney Happiness Ainebyona prayed court to cancel Kirabo’s bail and issue a warrant of arrest for him for skipping court, one of the requirements for his bail application.
“My lord one of the requirements for the accused (Kirabo) while he was granted bail was to attend every court session. Now he is missing, I pray that his bail is canceled and is issued a warrant of arrest as he might flee the country at this point.” - Happiness said.
Today the matter had appeared before justice Kaweesa for a trial in a trial session where court had tasked State Attorney Ainebyona to prove that a statement made at Kampala central police station by Kirabo were he confessed to murdering Mirembe was obtained through the right means.
Last week the accused’s lawyers led by Charles Dalton Opwonya objected to the statement being handed in to court as the state’s evidence on grounds that their client was tortured prior to giving his statement at Nalufenya prison.
Counsel Opwonya together with his colleague Ali Hassan Kato also promised to produce medical records proving their client’s medical condition to prove he was tortured however, their client did not turn up.
Justice Kaweesa asked the defense lawyers where their client was, counsel Opwonya said that their client had tested positive with Covid-19.
“My Lord our client has been admitted to hospital after testing positive for Covid-19," he said. "We pray that court gives us 25 more days when our client will next appear in court and will fully be healed.”
Justice Kaweesa then asked for the medical records proving their client was sick but they did not have any.
He then asked his mother and surety for his bail, Milda Wabulendo about herson’s health and she said that she had no idea the son was sick.
“I did not know he was sick until this morning when his lawyers told me,” she said.
It is after this that Justice Kaweesa canceled his bail and issued a warrant of arrest for him with immediate effect.
The matter was then adjourned to November 10.
Mirembe, 19, was murdered on July 10, 2015 by her boyfriend Kirabo and her body was on July 11, 2015 recovered from a sugarcane plantation in Lugazi-Kawolo, Buikwe District.
Kirabo reportedly confessed to the murder.
He was then charged at Jinja Chief Magistrates Court with murder and remanded at Nalufenya prison in Jinja.
Kirabo was later granted bail on November 24, 2016, which enabled him finish his Bachelor's degree in Medicine.
The case was later moved to Mukono High Court on the instructions of the then Principal Judge Yorokamu Bamwine after the state complained that the crime had been committed in the Mukono jurisdiction.
On October 6, the High Court in Mukono finally started hearing the case after 6 years.
