Court Okays Operationalization of Rubanda District

The decision quashed an application for an interim order filed by residents of Bubaare and Nyamweru Sub Counties, seeking to block the operationalization of the new district on grounds that they never wanted to remain in the mother district of Kabale.

High Court in Kabale district has Okayed the operationalization of the new district of Rubanda.

The decision quashed an application for an interim order filed by residents of Bubaare and Nyamweru Sub Counties, seeking to block the operationalization of the new district on grounds that they never wanted to remain in the mother district of Kabale.

On June 28, a group of residents from 69 villages led by Caleb Turyamutunga, a veteran soldier, filed an application before court to block the operationalization the new district which is set take place today July 1.

Through their lawyer Justus Muhangi of Muhangi and partners advocates, the residents argued that that the new district headquarters would take services further away from them contrary to the principles of decentralization.

They argue that the headquarters of the new district of Rubanda are situated 40 kilometers away as opposed to the mother district of Kabale, whose headquarters are located within a distance of 5 kilometers. The locals also filed a formal request to be annexed to Kabale Municipality.

However, Kabale Principal Assistant Secretary James Mugisha told court that the leadership of Kabale district has put in place all the necessary measures to ensure that the new district starts today. Mugisha added that a team of technocrats has been selected to run the district for a period of six months as further preparations are made.

The Deputy Registrar for Kabale High Court Samuel Emokor revealed that the district leadership of Kabale was served late and that the operationalization of the district could not hurt service delivery in the areas that would like to remain in the mother district. He advised the applicants to pursue the matter in the main suit which will be heard on July 13.

Kabale district chairperson Patrick Besigye Keihwa welcomed the decision saying that despite the fact that the locals would like to remain in the mother district, it is not prudent to block the new district from gaining autonomy.
