Court Orders KCCA to Pay Man UGX 20m for Illegal Arrest

A man who was arrested by Kampala Capital City Authority-KCCA law enforcement officers has been awarded 20 million shillings in compensation.

Steven Olango was arrested from his home in Ntinda in 2014 after hawkers who were fleeing from enforcement officers hid in his compound.

Court heard that in May 2014 when Olango asked the enforcement officers to identify themselves before accessing his premises, they beat him and bundled him into their truck.

KCCA instituted criminal charges of engaging in a disorderly manner Olango at City Hall Court.

But Olango was acquitted of the charges by the Chief Magistrate Elias Kakooza for lack of evidence against him.

Olango later dragged the government to the Civil Division for wrongful arrest and malicious prosecution. 

Through his lawyer Charles Dalton Opwonya, Olango asked to be compensated with 53 million shillings for the damages and inconveniences caused to him.

However, in his judgement, Justice Musa Ssekaana said that the money Olango had requested for was exorbitant. He decided to award him 20 million shillings as general damages.

Ssekaana added that Opwonya in the final proceedings reduced the special damages from over 53 million shillings to five million yet such claims can be sought from the Chief Magistrates Court.
