Election Petition against Kato Lubwama Set for Fresh Hearing

According to Dollo, court records indicate that the matter was heard before but the ruling was never delivered after the retirement of Justice Steven Kavuma. Dollo told both parties that a new panel of judges will be instituted and the case is heard afresh.

 A new panel of judges will be constituted to hear afresh a suit in which Lubaga South MP, Paul Kato Lubwama seeks to block an election petition. 

Through his lawyers Caleb Alaka and Samuel Muyizi, Lubwama went to the Court of Appeal challenging the High Court's orders in which Justice Margaret Oumo Oguli allowed an election petition to be filed by Habib Buwembo, the Secretary for Labour in the Forum for Democratic Change-FDC party.

Buwembo argued that the legislator lacked mandatory academic qualifications to be in Parliament. He also stated that Lubwama lacked documents indicating that he had sat for Primary Seven, Senior Four and Senior Six.

Buwembo also accused Lubwama of conniving with Makerere University and was admitted in 1992 for a diploma in Music, Dance and Drama yet he hadn't obtained the minimum mature age entry which is 25.

On Thursday, court presided by Deputy Chief Justice Owiny Dollo said that the case had been heard before a panel of judges led by Justice Steven Kavuma.

However, Lubwama's lawyer Samuel Muyizi disagreed with Owinyi Dollo, saying that case was never heard.

According to Dollo, court records indicate that the matter was heard before but the ruling was never delivered after the retirement of Justice Steven Kavuma. 

Dollo told both parties that a new panel of judges will be instituted and the case is heard afresh.
