FDC’s Oddo Tayebwa Losses Election Petition Against Bushenyi-Ishaka Municipality MP

FDC's Oddo Tayebwa lost the 14th January 2021 parliamentary elections after he collected 5,898 votes against NRM's Derrick Kabuura who collected 8,199 votes, Others in the race were Yedidia Nyakahangura of ANT who got 734 votes, Kenneth Akanduhura independent 166 votes, Elly Ahabwe Rukira independent 47 votes, Nasser Nduhukire independent 13 votes.

High Court in Mbarara has on Thursday dismissed with costs an election petition filed against Bushenyi-Ishaka Municipality Member of Parliament Derrick Kabuura.

The Forum for Democratic Change (FDC) candidate and former Member of Parliament Odo Tayebwa had filed a petition challenging Kabuura’s victory on grounds that he engaged in voter bribery and intimidation of voters and agents on the voting day.

Tayebwa, through his counsel Frank Kandiho also told the court that the electoral commission did not comply with the provisions of the parliamentary Elections Act 2005 and the principles governing and regulating the conduct of elections.

Tayebwa prayed to the court to annul Kabuura’s victory and order for fresh elections in Bushenyi-Ishaka Municipality.

Kabuura through his lawyers led by Geoffrey Kandeebe asked the court to throw out the petition and declare Kabuura as a duly elected member of Parliament.

In his Judgement Justice Moses Kawumi Kazibwe, which was read by the acting Deputy Registrar Samuel Twakyire, dismissed the petition with costs noting that he considered all the allegations raised by the petitioner against the respondent and was not proved to the satisfaction of the court.

Justice Kazibwe also awarded costs to the three lawyers that were instructed by Hon Derrick Kabuura.

Shortly after the Judgement, Tayebwa’s lawyer, Brian Moogi told the court that they were not convinced with the judgement and that they will appeal.

Kabuura, welcomed the judgement and asked his opponents to come and join him to develop Bushenyi- Ishaka Municipality.
