Lawyer Muhangi Withdraws from Ndorwa East Loser’s Election Petition Appeal

In a leaked notice dated 20th November addressed to the electoral commission, Niwagaba and his lawyers, M/S Lukwago and Company Advocates, M/S Barirere Muhangi, and Company advocates, Muhangi indicates that he has withdrawn from handling the case. Muhangi did not give details and explanation behind his withdrawal from the case.

Justus Muhangi of Muhangi and Partners Advocates, one of the lawyers who was undertaking an appellate election petition against Ndorwa East county member of parliament in Kabale district has withdrawn from the case.   

The Electoral Commission declared Wilfred Nuwagaba the winner with 15,962 votes against Begumisa's 15,826 votes.  

Begumisa who contested on the National Resistance Movement party ticket petitioned the High Court in Kabale seeking to overturn the victory of Nuwagaba on grounds of voter bribery, harassing of his agents, and vote-rigging reportedly while conniving with police officers.   

But on November 2, Justice Phillip Odoki dismissed Begumisa's petition with costs on grounds that Begumisa had failed to prove to the satisfaction of the court the evidence related to harassment, vote-rigging, and other grounds he had adduced in his petition.

 However, on 5th November, Begumisa appealed to the court of appeal arguing that he was not convinced by Odoki’s judgment.      

Now in a leaked notice dated this month 20, addressed to the electoral commission, Niwagaba and his lawyers M/S Lukwago and Company Advocates, M/S Barirere Muhangi, and Company advocates, Muhangi indicates that he has withdrawn from handling the case. Muhangi did not give details and explanations behind his withdrawal from the case.

  But, an inside source from Muhangi’s law firm told our reporter that Muhangi was forced to withdraw unhappy with Begumisa's and failure to pay him.   

When contacted, Begumisa instead accused Muhangi of writing a notice of withdrawing from the case that he is not involved with. 

Begumisa describes Muhangi’s act as a mistake. He says that Muhangi only helped him to draft a notice of intention to appeal.  

Begumisa says that his petition currently before the court of appeal is being handled by other lawyers he identified as Kesiime and Company Advocates.
