Medical Analysis Finds Defilement Victim A Virgin

Dr Barungi Thaddeus, a police surgeon attached to Bombo Road Police clinic told court this morning that he examined the victim on June 23, 2016, nine days after she had allegedly been defiled and found no injuries or evidence that she had ever been penetrated. His scientific conclusion indicates that the hymen and introitus of the young girl were virginal.

A doctor who examined a 12-year-old victim of defilement has told Court she was still a virgin at the time of the examination.

The state had alleged that the student had been defiled by Mark Rashid, 31, a resident of Wamala, Nansana Municipality, Wakiso District. It is further alleged that Rashid gained access into the girl's dormitory at Makos High School, and had sexual intercourse with a student who was staying in the school. Rashid has been on remand at Luzira Prison for the last two years.

The victim had earlier told the court that Rashid, a brother to the school Director Gideon Makokha took advantage of her being sick to chase away other students including a friend of hers and defiled her before sending her home. She said, the bursar switched off the dormitory lights, pulled down her mattress and had sexual intercourse with her there.

But Dr Barungi Thaddeus, a police surgeon attached to Bombo Road Police clinic told court this morning that he examined the victim on June 23, 2016, nine days after she had allegedly been defiled and found no injuries or evidence that she had ever been penetrated. His scientific conclusion indicates that the hymen and introitus of the young girl were virginal.

Rashid's lawyer Faisal Mulalira went ahead to table the police Form 3A which was signed by Dr Barungi. The Police Form had initially been prepared as part of the key evidence that would be used by the prosecution to prove the case of defilement.

However, prosecution led by State Attorney Jacqueline Okui decided not to table it. The defense equally closed their case and asked the court to put into consideration all gaps and doubts arising out of the findings of the medical team.

The evidence against Rashid was further watered down by the denial of a 17-year-old friend to the ‘victim' who stated that she never saw Rashid enter their dormitory or chasing them out.

The student also told the court that it was impossible for the lights to have been switched off in the dormitory and her friend defiled without all the female students noticing given that the dormitory was a few meters away from the reading room.

Mark Rashid, on the other hand, told the court that he had never entered the girl's dormitory since he joined the school and that he suspected that Agnes Nakanjako, the brother's wife who had been relieved of her duties as the school bursar five months before the incident had framed her.

His statement was supplemented by the victim's friend who told the court that the victim had told her while at Police that the grandmother had forced her to say that Rashid defiled her so that he can go to prison and Nakanjako takes over as bursar again.

Another defense witness was the matron to the school who told the court that on the night the incident is alleged to have occurred, she was in the dormitory together with Nakanjako who was suffering from a swollen Lymph node the whole night.

The state presented the victim's grandmother who was the complainant and the investigating officer who told the court that the victim had given uncoordinated statements in regard to the scene of the crime.

According to the officer, Detective Lynette Akello at first, the victim had said she was defiled from her mattress on the floor but once at the scene she changed and said she was defiled on her friend's bed.

The case has been adjourned to December 12, 2018, for judgment.

A similar revelation happened in Iganga district in 2011, when a 13-year-old girl, who alleged that her grandfather defiled her, was found a virgin. The man had been arrested after residents alleged that his was found fondling with his granddaughter in a garden. The girl also told police that her grandfather had defiled her since 2009.
