Municipal Council Loses UGX 45m In Court Suit

Chief magistrate’s court sitting in Bushenyi town Thursday ruled that Bushenyi -Ishaka municipal council pays 45 million shillings with interest of 19 years to the family of late Muhumuza Emmanuel for illegally occupying his land.
Bushenyi-Ishaka Municipal council has been ordered to pay 45 million shillings plus interest over a 19-year-period, for illegally grabbing family land.


The Chief magistrate’s court in Bushenyi town found council liable for grabbing the land that belonged to the family of Muhumuza Emmanuel (Deceased).


Muhumuza Manfred, a son to to the deceased dragged Bushenyi -Ishaka town council to court, challenging tha manner in which their land was forcefully grabbed by the town council, now turned municiplaity.


The six-hectares piece of land now houses the Bushyenyi-Ishaka main taxi and Bus Park, more than 100 lockups and access roads.


Muhumuza says that council grabbed their land in1993 displacing the entire family. According to the suit, the displacement resulted into the death of Muhumuza Emmanuel and his wife Mary.


The civil suit which has been dragging on for 19 years was disposed off  on Thursday after the chief magistrate, Charles Kisakye, ruled in favour of the plainants.


Court ordered that Bushenyi Municipal council immediately halts  all the activities on the contentious piece of land and prepares to pay a cost of the suit.


But the mayor Bushenyi Ishaka municipal council, Jackson  Kamugasha, maintains that the land in question belongs to Government and has instructed their lawyer Tumwesigye of Tumwesigye and company advocates to appeal against the court ruling.
