Pro-Lukwago Team Finalizes Judicial Review Paperwork

The team challenging recommendations of the KCCA tribunal report against Kampala Lord Mayor Erias Lukwago has finalised its paperwork and it’s now ready to file for a judicial review, Lukwago's lawyer Abdul Katuntu says.

Katuntu is optimistic that the Tribunal report will be thrown out on grounds that it was shallow, biased,  lacks depth in analysis of the problems of Kampala and conquers the sovereignty of the people who voted Lukwago into office.

Last week, Justice Catherine Bamugemereirwe released the KCCA tribunal report which found Lukwago guilty of abuse of office, incompetence and misconduct as petitioned by a cross section of KCCA councillors.

Katuntu argues that no institution acting judiciously can let such a report stand and that their view is to take legal steps to make sure that the Justice Bamugemereire report is over turned.

He says that although the tribunal was properly constituted under the KCCA Act, the report its self lacks in law and needs a thorough judicial review.

“We want to give the judiciary a benefit of doubt and the judiciary would be conscious of the problems that might arise out of them not prosecuting the application” Katuntu says

Katuntu thinks that the biggest mistake the justice Bamugemereire Tribunal made was to imagine that any small thing or mistake a leader makes is an impeachment offence.

He noted that just not long ago, president Museveni nominated Justice Benjamin odoki to be chief justice without recommendation from judicial service commission as provided for by the constitution questioning whether this would have amounted to an impeachable offence of the president since he acted contrary to the law.
