The court presided over by Col. Geoffrey Mujuni, passed the sentence after Tumwebaze pleaded guilty to shooting dead Bwambale Tibenda, a student of Burambagira Secondary School.

The 2nd Division Army Court Martial has sentenced lance corporal Sam Tumwebaze to 30 years in prison for manslaughter.
The court presided over by Col. Geoffrey Mujuni at Kirumya Sub County Headquarters, passed the sentence on Wednesday after Tumwebaze pleaded guilty to shooting dead Bwambale Tibenda, a student of Burambagira Secondary School.
Tumwebaze committed the offence on October 31, 2018, at around 5 am at Kyapa trading Center in Bugarama village, Kirumya Sub-county, Bundibugyo district.
The court heard that Tumwebaze was trying to stop and disperse an illegal musical concert that Tibenda was attending.
According to the witnesses who testified, Tibenda shot several times in air and on the ground and a stray bullet hit Tibenda killing him instantly.
“The fact that the offence is of a capital nature and should be expelled, it is on that basis that the accused, is sentenced to 30 years' imprisonment from the date of arrest and you have a right of appeal within 14 days from today,” said Mujuni while announcing the sentence.
At the time of his death, Tibenda was a S.4 candidate.
Gerald Bamwitirebye, the Defense counsel, said they will appeal for a lighter sentence because the convict is the sole breadwinner for his family.
